Terms and Conditions of FintixAI

1. Introduction

Welcome to FintixAI, a mobile application designed to manage expenses and control debts, powered by Artificial Intelligence, operated by Trego LLC. By using our application, you agree to comply with these Terms of Service. If you do not agree, please do not use the application.

2. Service Description

FintixAI offers users a tool to manage their personal finances, controlling expenses and debts, with personalized recommendations provided by an Artificial Intelligence system. The app includes an AI conversational assistant ("AI Assistant") that processes text messages and images to help users with their finances. The app is available on Android and iOS devices.

3. User Registration

To use FintixAI, you must register by providing a valid email address. Users can register through Google and Apple. It is the user's responsibility to ensure all information provided is truthful, accurate, and up to date. Each user is responsible for maintaining the confidentiality of their account.

4. Application Use

The use of FintixAI is permitted exclusively for personal and non-commercial purposes. Users agree not to use the app for illegal or unauthorized activities. FintixAI grants a non-exclusive, non-transferable, and revocable license to use the app in accordance with these Terms.

5. AI Assistant Service

FintixAI features an artificial intelligence conversational assistant ("AI Assistant") designed to help users manage their personal finances.

Nature of the service

The AI Assistant is a support tool based on language models. It processes text messages and images to provide general financial information, analysis, and recommendations. It is not a certified professional financial advisor. Responses generated by the assistant do not constitute financial, legal, or tax advice.

Limitations

  • The AI may make mistakes or generate inaccurate responses. Users should always verify important information before making financial decisions.
  • Financial decisions should not be made solely based on the assistant's recommendations.
  • The service is in development (beta) and may present occasional inaccuracies or failures.

Chat privacy

  • Messages and images sent to the chat are processed through AI providers (OpenAI and open-source models). These providers do not store or retain user data.
  • Memories and summaries generated by the assistant are stored securely to personalize the experience while the account is active.
  • If authorized by the user, their data may be anonymously analyzed to improve service quality. This setting can be enabled or disabled at any time from the app.

6. Intellectual Property Rights

All content, design, logos, and graphics within FintixAI are the exclusive property of the company or its licensors. Users may not copy, modify, distribute, reproduce, or sell any elements of the app without express authorization.

7. User Responsibilities

By using FintixAI, users agree to:
  • Not use the app to commit fraud or illegal activities.
  • Not attempt to gain unauthorized access to our systems.
  • Keep their account and password secure.
  • Comply with all applicable laws when using the app.

8. Prohibitions

The following actions are prohibited in FintixAI:
  • Abusive use of the service that negatively affects other users' experience.
  • Sending spam, unsolicited messages, or inappropriate content.
  • Manipulating, hacking, or interfering with the app's operation.
  • Sending illegal or harmful content through the chat, or content that infringes third-party rights.
  • Attempting to manipulate, trick, or perform "jailbreak" on the artificial intelligence assistant.
  • Uploading images containing sensitive data unrelated to financial management.

9. Payments and Subscriptions

FintixAI offers premium features through subscriptions or in-app payments.

  • Monthly: $9.99/month (billed monthly)
  • Annual: $5.83/month (billed at $69.99/year)

Automatic renewal: The subscription will automatically renew unless canceled at least 24 hours before the end of the current period.

Subscription management: Users can manage or cancel their subscriptions in their account settings on the App Store or Google Play.

Non-refundable: No refunds will be issued for unused periods.

Google Play refund policy: For purchases made on Google Play, refunds are governed by Google Play Store policies. Users can request a refund through Google Play support if they meet their requirements.

10. Data Storage and Security

  • Information is stored on AWS (Amazon Web Services).
  • All passwords are encrypted before being stored.
  • Data is encrypted both at rest and in transit whenever it is accessed or added to the database.

11. Privacy and Data Protection

The use of FintixAI is subject to our Privacy Policy where we explain how we collect, use, and protect user information.

12. End User License Agreement (EULA)

The use of FintixAI is subject to the standard Apple EULA.

13. Limitation of Liability

FintixAI does not guarantee that the application is error-free or that it will function uninterruptedly. We are not responsible for:
  • Loss of data or information.
  • App functionality failures.
  • Indirect, special, or incidental damages arising from the use of the application.
  • Financial decisions made based on responses generated by the AI assistant.
  • Errors, omissions, or inaccuracies in responses provided by the artificial intelligence assistant.

14. Modification of Terms

We reserve the right to modify these Terms of Service at any time. If we make changes, we will notify users through the app or email. It is the user's responsibility to periodically review the updated terms.

15. Dispute Resolution

In the event of any dispute related to the use of FintixAI, we are committed to resolving it amicably. If an agreement cannot be reached, the dispute will be resolved under the laws and jurisdiction of the State of New Mexico, United States.
